BYG Terms and Conditions
1. Acceptance of Terms
By using BYG’s services — whether verbally, by phone, email, text, or through the website — the customer agrees to these Terms and Conditions. This includes acceptance of all liability provisions (three-layer protection: verbal review by project managers, click-to-agree via link, and acceptance by continued use of services).
2. BYG’s Role
BYG acts as a referral and coordination service. We may refer work to third-party service providers or perform certain services ourselves using our own team or contractors.
3. Independent Contractor Status
All service providers referred by BYG are independent contractors and not employees, agents, or representatives of BYG. BYG does not supervise, direct, or control the actual performance of the work by service providers.
4. No Guarantee of Third-Party Work
BYG does not guarantee the quality, workmanship, timeliness, or outcome of any work performed by third-party service providers. We are not responsible for any property damage, personal injury, or financial loss caused by service providers. We will make reasonable efforts to assist in resolving issues.
5. No Supervision of Work & Customer Responsibilities
BYG does not supervise, manage, or control the actual performance of any work by service providers.
All communication between the customer and the service provider must be made through BYG. It is the customer’s sole responsibility to clearly communicate their requirements to their BYG project manager and to actively monitor the work. This responsibility remains with the customer even if a BYG project manager fails to properly communicate the customer’s instructions to the service provider.
Customers have both the right and the responsibility to instruct the service provider to stop work if they are unsatisfied. Service providers are required to immediately stop work if the customer appears unsatisfied, until the issue has been clearly communicated through BYG and both the customer and BYG have given approval to resume work.
Failure to follow these procedures may result in the customer or service provider assuming responsibility for any resulting damages, claims, or disputes.
6. Insurance
It is the sole responsibility of both the customer and the service provider to verify that their insurance will cover the specific work being performed. BYG does not verify either party’s insurance coverage.
The party that does not have proper insurance must pay for a temporary insurance policy. If both parties lack insurance, they will split the cost. If either party elects not to pay for the temporary insurance policy or to seek one, they are 100% responsible for any damages or injury that arises from the use of our services.
7. Dispute Resolution
BYG will attempt to mediate any conflict between the customer and the service provider. However, we cannot control how either party acts. If our mediation efforts fail, it is the responsibility of the homeowner and service provider to seek resolution on their own. BYG will not be liable for any costs or outcomes resulting from such disputes.
8. Limitation of Liability
To the fullest extent permitted by law, BYG’s total liability to any customer or service provider shall be limited to the amount paid by the customer to BYG for the specific service or job.
9. Limitation on Damages
IN NO EVENT SHALL BYG BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF USE, LOSS OF PROFITS, OR BUSINESS INTERRUPTION.
10. Indemnification
By using our services, both customers and service providers agree to indemnify, defend, and hold harmless BYG, its owners, employees, and agents from any claims, damages, losses, liabilities, and expenses.
11. Refund and Cancellation Policy
All sales are final once the services have been completed and payment has been released to the service provider.
If a customer is dissatisfied with completed work, they must notify BYG in writing within 48 hours. BYG will make reasonable efforts to mediate a resolution, but is not obligated to issue a refund.
Customers may cancel before work begins and receive a refund less project management fees already incurred. After work has begun, the customer is responsible for all work completed up to the point of cancellation and may be charged a cancellation fee. BYG reserves the right to charge for additional project management time.
Customers who wish to cancel must immediately notify their BYG project manager. If the service provider is on site, the customer must instruct the service provider to stop work.
12. Work Product and Intellectual Property
All reports, forms, documentation, photos, schedules, and other materials created or provided by BYG are the sole intellectual property of BYG.
Any photographs, videos, or images taken by BYG, its employees, or its vendors may be used by BYG for marketing and social media purposes unless the customer notifies BYG in writing within 48 hours after job completion that they do not want the images used.
13. User Accounts
Both customers and service providers may create accounts. Users are responsible for maintaining the confidentiality of their account credentials and are fully responsible for all activity that occurs under their account. BYG reserves the right to suspend, terminate, modify, or restrict any account at its sole discretion.
14. Reviews
Users may submit reviews only for services they have actually received through BYG. BYG reserves the right to remove any review that violates these Terms or is otherwise inappropriate.
15. Arbitration and Class Action Waiver
Any dispute arising out of or relating to these Terms or our services shall be resolved through binding arbitration in San Juan, Puerto Rico. You waive any right to participate in a class action lawsuit or class-wide arbitration against BYG.
16. Force Majeure
BYG shall not be liable for any failure or delay caused by events beyond its reasonable control, including hurricanes, acts of God, or government orders.
17. Prohibited Conduct
Users agree not to misuse our services, submit false information, harass staff or providers, request illegal services, or circumvent our processes.
18. Disclaimer of Warranties
Our services are provided “as is” and “as available” without any warranties of any kind.
19. Termination Rights
BYG reserves the right to refuse service or terminate any relationship at its sole discretion.
20. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
21. Waiver
Failure by BYG to enforce any provision does not constitute a waiver of future enforcement.
22. Entire Agreement
These Terms constitute the entire agreement between you and BYG.
23. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Puerto Rico. Any legal action shall be brought exclusively in the courts located in San Juan, Puerto Rico.
